📋 Introduction
Welcome to Smarter Timesheet by Smarter Business Solutions GmbH! We invite you to use Smarter Timesheet in SharePoint Online and Microsoft 365. Doing so requires that you accept these terms of use.
Whenever we refer to "us", "we", "Smarter Business" or "Smarter Business Solutions", we mean the Smarter Business Solutions GmbH entity that provides Smarter Timesheet .
Please read the following terms carefully so you understand your rights and obligations when using Smarter Timesheet .
1 Changes to the Terms
We may update these terms whenever needed to reflect new market conditions, internal adjustments, revised payment methods, technological progress, legal requirements, or system updates. We will notify you of material changes via email sent to the address you provided. A change becomes effective as soon as we publish the revised terms on our website. By continuing to use Smarter Timesheet after publication you accept the updated terms. Please review these terms regularly to stay informed.
2 Fees and Payments
The product is available through the Microsoft Marketplace. Pricing is automatically shown in your local currency.
Licensing:
- Free trial available
- Flexible subscription models via Microsoft Marketplace
- Please contact us for enterprise pricing.
We will inform you of any subscription fee changes in good time so you can cancel your subscription before new prices take effect.
3 Limitations
Under no circumstances will Smarter Business Solutions GmbH, its directors, employees, partners, agents, suppliers, or affiliates be liable for indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, lost profits, data, use, goodwill, or other intangible losses arising from:
- your access to or use of the service or the inability to access or use the service
- any conduct or content of third parties within the service
- any content obtained from the service
- unauthorized access to, use of, or alteration of your transmissions or content
4 Disclaimer
Important:
You use the service at your own risk. The service is provided "AS IS" and "AS AVAILABLE".
The service is provided without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.
Smarter Business Solutions GmbH, its subsidiaries, affiliates, and licensors do not guarantee that:
- the service will be uninterrupted, secure, or available at any particular time or location
- any errors or defects will be corrected
- the service is free of viruses or other harmful components
- the results of using the service will meet your requirements
5 Intellectual Property
Smarter Business Solutions GmbH retains the exclusive and worldwide rights to all intellectual property related to the software, whether or not it is patentable or registered. This includes, without limitation, the source code, software protocols, interface design, concepts, methods, designs, and trademarks.
License restrictions:
The license granted under this agreement is non-exclusive, revocable, and non-transferable. Customers may not copy, modify, reverse engineer, upload, distribute, transfer, sublicense, rent, lend, or otherwise provide the software to third parties.
Any rights not expressly granted to the customer remain with Smarter Business Solutions GmbH and its third-party licensors.
6 Governing Law
These terms are governed by Austrian law without regard to conflict-of-law rules.
If any provision of this agreement is held to be invalid or unenforceable by a competent court, the remaining provisions remain in full force and effect. Any invalid or unenforceable provision shall be interpreted to best preserve the intent of the original wording.
